Stand with Hong Kong Global Joint Statement on the arrest of 11 Hongkongers

2021, the National Security Department of the Hong Kong Police Force arrested 11 Hongkongers for aiding the escape attempt in August of twelve Hongkongers. Among the arrested was District Councillor Daniel Wong Kwok-tung, an active and fervent legal defender for numerous protesters charged by the Hong Kong SAR government. Using the illegitimate National Security Law (“NSL”) as pretext, this is the latest round of crackdown to suppress political dissent in 8 days.

The duties and functions of the National Security Department of the Hong Kong Police Force are limited to the offences under the NSL. The alleged offenses of the 11 arrested on Thursday do not fall within the scope of power given to the National Security Department of the Hong Kong Police Force. The preposterous use of the National Security Department of the HKPF to arrest the 11 Hongkongers again demonstrates that the true intent of the government and the police lies not in national security but in the removal of all kinds of dissenting voices in the city.

Since the peremptory enactment of the National Security Law 6 months ago, the Hong Kong government has deployed this draconian law to impose on the city the same “stability maintenance” policy that is the norm in CCP China. The government’s Department of Justice has used the law in questionable applications for the purpose of intimidating the government’s opponents, forcing these dubious cases through the court system, threatening the independence of the presiding judges. The maneuver is Beijing’s attempt to apply political pressure on Hong Kong’s judges, with a result that would devastate the city’s now-fragile independent judiciary and common law system, the legal framework that differentiates Hong Kong from the rest of China.

The imposition of NSL in Hong Kong by CCP China is a “clear and serious breach” of the 1984 Sino British Joint Declaration. It is also incompatible to the human rights and freedoms guaranteed to Hongkongers under the International Covenant on Civil and Political Rights. The application of this illegitimate law constitutes direct violations of international treaties.


We demand the Hong Kong SAR government and Hong Kong Police Force immediately:

(a) release of the 11 Hongkongers arrested on 14 January and any persons detained under the NSL;

(b) withdraw any charges of NSL against any persons;

(c) dissolve the the National Security Department of the Hong Kong Police Force; and

(d) cease the implementation of the NSL.

We further demand the CCP China and Hong Kong SAR government abolish the NSL in Hong Kong.

We urge the international community to stand with Hong Kong on the following measures:

(a) insert human right protection clauses with punitive measures in any trade deals with CCP China;

(b) enact Magnitsky-like sanctioning laws to hold CCP China and Hong Kong officials accountable to any human right violations in Hong Kong and in China; and

(c) devise policies specific to Hong Kong to halt and reverse the erosion of Hong Kong’s autonomy.

We specifically urge:

(a) 🇺🇸 the US government to closely review these latest arrests under the NSL and impose all relevant measures under US laws as response. We further urge President-elect Joe Biden to voice support for the victims of the NSL. The United States must be the example of the free world by enacting lifeboat policies for Hongkongers and to use all available tools to confront CCP China’s repression to its own people and to Hongkongers;

(b) 🇬🇧 the UK parliamentarians to pass the Hong Kong Bill 2019-2021 to provide wider protection to Hongkongers and to impose sanctions for breaches of the Sino-British Joint Declaration; and

(c) 🇪🇺 the EU parliamentarians and the EU Council to insist on the inclusion to the China-EU Investment Agreement meaningful provisions to protect human rights in China and in Hong Kong; and to use all available tools to work with the UK and US governments to confront CCP China’s repression to its own people and to Hongkongers.

Last but not least, we echo 黃國桐 Daniel Wong Kwok-tung’s clamour: “Hongkongers, Never never ever give up on Democracy, Rule of Law, and Human RIghts!” That we believe these universal values cherished by mankind will prevail.
